उत्तराखंड में त्रिस्तरीय पंचायत चुनाव को लेकर जारी असमंजस की स्थिति शुक्रवार को समाप्त हो गई। नैनीताल हाईकोर्ट ने पंचायत चुनाव प्रक्रिया पर लगी रोक को हटाते हुए सरकार को राहत दे दी है। मुख्य न्यायाधीश जी. नरेंद्र और न्यायमूर्ति आलोक मेहरा की खंडपीठ ने राज्य सरकार द्वारा पेश किए गए आरक्षण रोस्टर एवं गजट नोटिफिकेशन को पर्याप्त मानते हुए चुनावी प्रक्रिया को आगे बढ़ाने की अनुमति दे दी।
21 जून को राज्य सरकार ने पंचायत चुनाव की अधिसूचना जारी की थी। लेकिन 23 जून को हाईकोर्ट ने आरक्षण प्रक्रिया में अनियमितता के आरोपों पर संज्ञान लेते हुए चुनावी प्रक्रिया पर रोक लगा दी थी। याचिकाकर्ताओं ने आरोप लगाया था कि आरक्षण की रोटेशन प्रणाली में मनमाने तरीके से बदलाव किए गए हैं, जो संविधान के अनुरूप नहीं हैं।
शुक्रवार को हुई अहम सुनवाई के दौरान राज्य सरकार ने कोर्ट को सूचित किया कि 14 जून को आरक्षण से संबंधित गजट नोटिफिकेशन जारी किया जा चुका था, लेकिन ‘कम्युनिकेशन गैप’ के कारण यह जानकारी अदालत तक समय पर नहीं पहुंच सकी। अदालत को गजट की प्रति प्रस्तुत की गई, जिसे स्वीकार करते हुए कोर्ट ने चुनाव प्रक्रिया पर लगी रोक को हटा दिया।
हाईकोर्ट के इस निर्णय के बाद राज्य निर्वाचन आयोग के लिए अब चुनाव कार्यक्रम की घोषणा का रास्ता साफ हो गया है। सरकार ने भी स्पष्ट किया है कि चुनाव की सभी तैयारियां पूरी कर ली गई हैं। कोर्ट ने यह भी स्पष्ट किया कि चुनाव प्रक्रिया संविधान के अनुरूप आगे बढ़ेगी।
याचिकाकर्ता गणेश दत्त कांडपाल ने कोर्ट में दलील दी थी कि पूर्व की रोटेशन नीति के अनुसार तीन कार्यकाल बाद सीटों का आरक्षण बदला जाता था, लेकिन इस बार सरकार ने कुछ सीटों को लगातार चौथे कार्यकाल तक आरक्षित कर दिया, जो रोटेशन की मूल भावना के विपरीत है।
कोर्ट के फैसले को राज्य में पंचायत शासन की समयबद्ध बहाली की दिशा में एक महत्वपूर्ण कदम माना जा रहा है। इससे न केवल सरकार को राहत मिली है, बल्कि ग्रामीण विकास की प्रक्रिया को भी गति मिलेगी।
